The Federal Department of Foreign Affairs (FDFA) has amended the Annex to the Ordinance on Measures Against Certain Individuals from Tunisia. Through its rapid precautionary freeze of funds, the Federal Council intends to facilitate legal assistance with the Tunisian authorities in view of the possible initiation of criminal procedures. Switzerland has in the meantime received an application for legal assistance from Tunisia. The information on individuals affected by the Swiss measures could therefore be amended to reflect the criminal procedures that have been, or can be expected to be initiated in Tunisia. The amendments enter into force today.

The Federal Council approved the Ordinance on Measures Against Certain Individuals from Tunisia on 19 January 2011. The Annex to the Ordinance contains a list of persons affected by these measures. The FDFA can amend the Annex. This list of individuals was compiled on the basis of information available at a particular point in time and may be amended in light of new information.

By imposing a precautionary freeze on the funds in question, the Federal Council wanted to prevent any assets of the former Tunisian president and his entourage being transferred to other destinations from Switzerland before the Tunisian authorities initiate possible criminal procedures and submit an application for legal assistance in criminal matters to Switzerland. In the meantime the Tunisian authorities have submitted an application for legal assistance. In addition, Tunisia has sent Switzerland a list of all individuals making up the entourage of its former president. Thus the Annex to the Ordinance can be amended on the basis of the procedures that have been, or are expected to be initiated in Tunisia.

These amendments take effect on 4 February 2011.

The Annex now contains the names of 48 individuals who have been subjected to the freeze on funds and other assets in accordance with the Ordinance.  23 new names have been added to the Annex to the Ordinance.
